Mortgage Forgiveness Debt Relief Set to Expire

There is a key piece of legislation set to expire at the end of this year which could have a HUGE impact on the real estate market & for many homeowners wanting to sell their homes. This legislation is the Mortgage Forgiveness Debt Relief Act of 2007 which exempts homeowners from having to pay tax on up to $2,000,000 in qualified forgiven debt. Only cancelled debt used to buy, build or substantially improve a principal residence or refinance debt incurred for those purposes qualifies. Essentially this directly impacts the feasibility of homeowners selling their homes through a short sale.

As an example, let’s say Homeowner X purchased a property for $300,000 back in 2005 and got a mortgage for $275,000. Today Homeowner X can only sell that property for $200,000 and the remaining balance of the loan is $265,000 there remains a shortfall (deficiency) of $65,000 ($265,000 remaining loan balance – $200,000 sales price). With Arizona specifically being a “non-deficiency judgment” state for most primary residences, the bank is prohibited from pursing Homeowner X for the unpaid balance (please always consult a lawyer for your specific scenario), but the $65,000 deficiency is normally considered income under IRS tax law. Clearly being taxed on the $65,000 of “income” would have a huge impact on whether Homeowner X would wish to proceed with the short sale. The Mortgage Forgiveness Debt Relief Act of 2007 removed this $65,000 tax burden in many cases, making short sales much more feasible for owners by not having to incur taxes on money they never physically received.

With this legislation set to expire on December 31st, that essentially means any homeowner in a short sale situation right now who isn’t definitely closing on that house by the end of the year may have an increased tax burden should the home sell. The real estate community is certainly leading the charge to try and have this debt relief extended by Congress, but in our current “lame-duck” session the prospects of that happening aren’t likely. It’s possible that new legislation could be introduced next year and be made retroactive but there is simply no guarantee. The effects of not extending the debt relief will be widespread. This includes making it more difficult for homeowners “underwater” to sell their homes and that will further limit the already low inventory of homes on the market today.

HomeServices of America Grows Larger!

Just over a week ago Berkshire Hathaway’s HomeServices of America, which owns Long Realty Company, announced a major expansion of its real estate holdings by becoming the majority shareholder in a venture with Brookfield Asset Management Inc. Berkshire Extends Housing Bet With Brookfield Venture

Warren Buffett’s Berkshire Hathaway Inc. (BRK/A) is extending its bet on the U.S. housing market by forming a venture with Brookfield Asset Management Inc. (BAM/A) as low interest rates, inventory and prices spur a real-estate rebound.

Berkshire’s HomeServices of America Inc. unit will be the majority owner of the venture to manage a U.S. residential real- estate affiliate network, according to a statement on the new company’s website. The firms plan to offer a new franchise brand, Berkshire Hathaway Home Services, starting next year. Brookfield’s network has operated under the Prudential Real Estate and Real Living Real Estate brands.

Berkshire’s managers have been positioning the firm to benefit as the U.S. home market recovers from its worst slump in seven decades. The Omaha, Nebraska-based company has bought a brickmaker, won the loan portfolio of bankrupt mortgage lender Residential Capital LLC at auction and built its HomeServices unit by agreeing to acquire real-estate brokerages in states including Oregon and Connecticut.

“We have significant inventory shortage across the country” and prices have fallen, HomeServices Chief Executive Officer Ron Peltier said in a phone interview. “When you add the pieces up together with low interest rates, we see a housing market that will continue to improve.”

Berkshire Class A shares declined less than 1 percent in New York trading on Oct. 26 to $129,725 and have gained 13 percent this year. Brookfield, based in Toronto, advanced 1.9 percent yesterday to C$34.90 and has surged 24 percent since Dec. 31.

Buffett’s Outlook

Buffett, 82, said in July that the U.S. home market was beginning to improve. Berkshire’s billionaire chairman and CEO tracks economic activity, in part, by studying the results of the company’s more than 70 operating businesses including ones that build manufactured homes, make paint and sell insulation.

“It was just a question of getting households in balance with” the supply of homes, Buffett told Bloomberg Television’s Betty Liu in a July 13 interview. “That happens in different paces in different parts of the country, but you have seen a much better balance developing here in recent months. And that’s why you’re seeing some pickup in prices in places.”

Housing prices rose 2 percent in August from a year earlier, the biggest gain since July 2010, according the S&P/Case-Shiller index of property values in 20 U.S. cities. The number of homes for sale in the U.S. dropped 18 percent last month from a year earlier, according the National Association of Realtors website.

Borrowing Costs

Federal Reserve policy makers have said they will keep borrowing costs near zero to help stimulate the economy. That’s led to near record-low interest rates on home loans. The average rate on a 30-year fixed mortgage was 3.63 percent, the Mortgage Bankers Association said last week.

The new company, HSF Affiliates LLC, will have a combined network of more than 53,000 agents operating in about 1,700 U.S. locations and who generated $72 billion in sales last year. The network will give HomeServices exposure to markets such as New York, Boston and Northern California, Peltier said.

Hurricane Sandy, which made landfall in New Jersey this week, may decrease inventory in the Northeast as homeowners assess damage, Peltier said. The storm battered homes in coastal states that account for about one out of every five U.S. real estate sales.

“Short-term, it makes properties harder to sell when parts of neighborhoods have been devastated,” he said.

Tucson Among Money's

For those who live here and appreciate the nearly year-round sunshine, it’s no surprise that Tucson should be listed among the 25 Best Places to Retire just published a couple weeks ago by Money magazine. Pima Air & Space Museum

Tucson is extremely fortunate to have one of the largest aviation museums in the world, and the largest aviation museum in the United States that isn’t government funded, in the Pima Air & Space Museum. Countless artifacts and over 300 aeronautical vessels are on display at the museum, including some one-of-a-kind items and other rare planes. Among the most distinctive planes on display are the SR-71 Blackbird, B-29 Superfortress, a previous Air Force One used by John F. Kennedy & Lyndon Johnson, and a rare WWII German V-1 “buzz bomb”. Easily the sleekest aviation piece at the museum and possibly ever built is the SR-71 which a phenomenal piece of engineering constructed by Lockheed’s “Skunk Works” division. Used as a reconnaissance plane by the Air Force from 1964 – 1998, this aviation marvel flew over 3,500 mission sorties during its storied career. Over the years this plane set many world records including an absolute altitude sustained flight record of 85,069 ft., an absolute speed record of 2,193.2 mph, and the record for speed over a recognized course (flying from New York to London in 1 hour 54 minutes and 56.4 seconds).

Another unique part of the tour offered at Pima Air & Space Museum is access to the “Boneyard”, or the Aerospace Maintenance and Regeneration Group (AMARG). Located just across the street at Davis-Monthan Air Force Base, the Boneyard is a storage facility for over 4,400 aircraft from the Air Force, Navy, Marines, Army, Coast Guard, and other governmental agencies such as NASA. The chief reasons for selecting Davis-Monthan as the site for this storage center were Tucson’s meager rainfall, low humidity, and alkaline soil. These conditions make it possible to store aircraft indefinitely with a minimum of deterioration and corrosion. In addition, the soil (called caliche) is hard, making it possible to park aircraft in the desert without constructing concrete or steel parking ramps.

A visit to the Pima Air & Space Museum is definitely worthwhile for any aviation enthusiast. Dress comfortably and in walking shoes as quite a bit of time can be spent walking around.

Nightfall at Old Tucson
